PREAMBLE
These provisions establish the general conditions of sale and use offered by the company SIXSŒURS on its website https:/ www.sixsoeurs.fr/ and aim to define the terms of sale of fashion items between SIXSŒURS and the Customer when placing an order, from payment to delivery.
SIXSŒURS is a simplified joint stock company with capital of 5,100 euros whose head office is located at 5 rue Nicolet - 75018 Paris and registered with the RCS under number 537 802 951, reachable Monday to Friday from 9 a.m. to 7 p.m. on 09 71 50 08 24 or by email contact@sixsoeurs.fr and whose intra-community VAT number is as follows: FR 08 537 802 951.
The acquisition of a product or service through this site implies unreserved acceptance of these conditions general terms of sale and use.
SIXSOEURS reserves the right to adapt or modify these general conditions of sale and use at any time. This site as well as all rights relating to it are the property of SIXSŒURS.
Any reproduction, in whole or in part, including of the SIXSŒURS brand, is systematically subject to the authorization of the owner.< /span>
BUY ON SIXSŒURS
Article 1: THE PRODUCTS
The products offered by SIXSŒURS are clothing items and fashion accessories.
Products are offered while stocks last. Only items appearing in the store on the day of the Buyer's consultation are offered for sale.
They are accompanied by a description that is as precise as possible but not exhaustive and non-contractual photos. The photographs of the products are as faithful as possible but cannot ensure perfect similarity with the product offered, particularly with regard to the colors, the representation of which may vary from one computer to another.
In the event of unavailability after placing the order, the Buyer will be informed by email and asked to modify order or cancel it, without this generating any claim for damages or interest against SIXSŒURS. SIXSŒURS will reimburse any payments for the canceled order to the Buyer.
Article 2: REGISTRATION ON THE SITE / CREATION OF AN ACCOUNT
For any order on the SIXSŒURS website, the Buyer must automatically create a customer account, in order to be able to manage their orders .
He must provide the following information:
Name & first name - Delivery address - Telephone number - Email - Bank details (necessary for purchase). This personal data will under no circumstances be disclosed to a third party.
An account activation confirmation will then be sent to them, summarizing their email address (login) and password in order to so that he can connect afterwards. Opening an account is free, with no obligation to purchase or sell on the Site.
Article 3: ORDER
The Buyer wishing to purchase a product on the SIXSŒURS site must have legal capacity or hold parental authorization. allowing you to place an order.
The conclusion of the sale will only be effective after sending an email confirming the registration of the order (with an order number) by SIXSŒURS, provided that the email address indicated by the Buyer in the registration form does not contain errors. The Buyer must verify the conformity of the information he provides to SIXSŒURS. The latter cannot be held responsible for possible entry errors and the consequences in terms of delay or delivery error. In this context, all costs incurred for reshipment will be the responsibility of the Buyer. In order to validate any order, the Buyer must necessarily accept these general conditions of sale and use.
Article 4: PAYMENT
The prices displayed are exclusively in euros and including tax. Prices are fixed but SIXSŒURS reserves the right to modify its prices at any time. However, these prices cannot be modified once the order has been validated. The prices indicated do not include participation in shipping and packaging costs which will be invoiced in addition as well as any promotional offers, indicated before final validation of the order.
SIXSŒURS implements all necessary means to ensure the security and confidentiality of data transmitted online. span>
For this purpose, all information is encrypted using the SSL protocol. This data cannot be detected, intercepted or used by third parties. They are also not stored on our computer systems. When asked to enter our credit card number, you can verify from your browser that you are in a secure area. We accept payments by credit card via the stripe and paypal platform.
The order validated by the Buyer will only be considered effective and the goods shipped when the bank payment centers concerned have given their agreement. In the event of refusal by said centers, the order will be automatically canceled and the customer notified by email. Furthermore, SIXSŒURS reserves the right to refuse any order from a customer with whom there is a dispute. A detailed invoice will be accessible on the site, in the My account section.
Article 5: DELIVERY, DEADLINES AND PRICES

DELIVERY
Deliveries are carried out by independent service providers. In mainland France, deliveries are made by Post - Colissimo Access (choice: simple, tracked, registered delivery, with or without acknowledgment of receipt).
In EU countries, deliveries are made by post via Colissimo with European tracking. Deliveries outside the EU are made by international postal services.
For deliveries outside mainland France, the Buyer undertakes to pay all taxes due on importation of products, customs duties, value added tax, and any other taxes due under the laws of the country in which the order is received.
Transport risks are borne by the Buyer. SIXSŒURS cannot be held responsible in the event of late delivery, loss, damage or other damage to packages during delivery. From the moment the package is left and registered at the post office, SIXSŒURS does not provide any follow-up. This is why we recommend taking out insurance for delivery. Upon receipt of the package, the Buyer must check the condition of the products before accepting delivery. In the event of damage noted on the delivery, the Buyer must mention his reservations on the delivery note and reiterate them to the carrier by registered letter with acknowledgment of receipt within three (3) days of delivery in accordance with the provisions of Article L.133-3 of the Commercial Code. He must also send a letter to SIXSŒURS by registered letter with acknowledgment of receipt of any damage due to transport within eight (8) days following receipt. No complaints will be accepted in the event of non-compliance with these formalities.
If you have not received your tracked colissimo after 5 days and no delivery notice has been sent to you , remember to check the situation of your package on the coliposte website.
The products are delivered with the supporting invoice to the address indicated by the Buyer on the order form. In the event of a delivery error following an incorrect delivery address given by the Buyer, the return and/or reshipment costs will be at their expense. In the absence of any recipient, a calling card will be left. The Buyer can then collect the package from their post office upon presentation of an identity card.
SIXSŒURS will, in any event, be released from its obligation to deliver in the event of: p>
- non-performance by the Buyer of any of its obligations (payment of price, accuracy of personal information) span>
- occurrence of a case of force majeure such as war, riot, fire, strikes, accidents and the impossibility of being supplied.

DEADLINES
The deadlines are given for information purposes only, they correspond to the means of processing, preparation and shipping of the command. Everything is done to ensure that they are quick and respected but they are without obligation. Lead times for international deliveries may vary by several days. Of course, the delivery time only begins once the amount of the order has been collected by SIXSŒURS.
Delivery times in mainland France usually observed are 2 to 7 working days. Business days do not include weekends and holidays. Delivery times may vary from one product to another as indicated in the product sheet.
In any case, the Buyer will be able to follow the delivery status of his package on the website of the poste www.coliposte.net.
In the event of late delivery, the Buyer must report it by email to the address contact@sixsoeurs.fr SIXSŒURS may therefore contact the post office in order to open an investigation (maximum delay 21 days) If during this period, the product is found, it will be redirected immediately to the Buyer's home. If, on the other hand, the product is not found at the end of the 21-day investigation period, the Post Office considers the package as lost.
The absence of dispute from the Buyer within 30 days of the order will constitute confirmation : the product will therefore be deemed delivered and accepted. It is therefore up to the Buyer to ensure that a dispute is filed before this deadline, particularly in the event of no delivery within a reasonable time, so that any useful verification can be carried out. No dispute of any nature whatsoever will be admissible beyond this confirmation or this deadline. Any dispute, to be admissible, must be made via the contact tool.

PRICES
Shipping costs include packaging, handling and postage.
SIXSŒURS advises the Buyer to group their purchases into a single order, because it is impossible to group two separate orders. If the Buyer wishes different delivery addresses, he must then place separate orders, indicating the desired delivery location for each. He will then have to pay shipping costs for each order.
Shipping costs are calculated at a flat rate depending on the country and the weight of the package. p>
If the Buyer wishes to insure his package in the event of loss or theft, he can choose Colissimo with insurance at the time of the choice of delivery. In this case, a colissimo with signature will be sent to him.
Article 6: WITHDRAWALS AND GUARANTEES

WITHDRAWAL
All products are subject to an exchange or refund except those marked otherwise .
In accordance with Article L121-20 of the Consumer Code, when a product has been purchased by an individual to a professional seller, the Buyer has a period of 14 working days from the date of receipt of the products to exercise his right of withdrawal without having to give reasons or pay penalties, with the exception of return costs.
Any return must be preceded by the prior agreement of SIXSŒURS and the allocation of a returns number.< /span>
In order to facilitate the processing of the request, SIXSŒURS asks the Buyer to send an email to the following address : contact@sixsoeurs.fr by indicating the number of their order , then return the item accompanied by the invoice to the following address: SIXSŒURS - 70 rue René Boulanger 4A Villa du Lavoir - 75010 Paris.

REFUND
The products must be returned in their original packaging, only by colissimo or carrier and must not have suffered damage even minor ones. They must not have been worn or washed. The Buyer will be reimbursed for the amount of their total purchase, including outbound delivery costs: return costs remaining at their expense. Damaged or incomplete products will not be returned. Any risk linked to the return of the order is the responsibility of the Buyer. It will therefore be up to the Buyer to keep all proof of return.
The Buyer will have the possibility of opting for a credit for the amount of the goods which will then be valid for a maximum of one year from from its broadcast. Reimbursement will be made by re-crediting your bank card (secure transaction). After the 14 day transaction period, no refunds will be made.

Article 7: COMPUTING AND FREEDOM
The personal information requested by SIXSŒURS is essential for the management of the Buyer's order. In accordance with the “Informatics and Liberties” law of January 6, 1978, the processing of this personal information is the subject of a simplified declaration no. 1572217 to the National Commission for Information Technology and Liberties (CNIL). The Buyer thus has at any time a right of access, modification, rectification and deletion of data concerning him with SIXSŒURS. He can exercise this by sending his request by email to SIXSŒURS.
Article 8: GUARANTEES
In no case can SIXSŒURS be held responsible for apparent or hidden defects or possible counterfeits of the products offered by the individuals presented on its site.
Article 9: INTELLECTUAL PROPERTY
SIXSŒURS owns the intellectual property rights of the site and all elements (text data, photos, comments, works, illustration and images) which are protected by law. Therefore, copying, downloading, and use of site materials is prohibited worldwide.
The user who has a personal website and who wishes to place, for personal use, on his site a simple link referring directly to the SIXSŒURS site, must first request authorization from SIXSŒURS.
Article 10: APPLICABLE LAW - JURISDICTION
These General Conditions of Sale will be executed and interpreted in accordance with French law. In the event of a dispute with a buyer, the French courts will have sole jurisdiction. SIXSŒURS cannot be held responsible for damages of any nature, whether material, immaterial or bodily, which could result from malfunction or misuse of the products sold. In the event of difficulties in the application of this contract, the buyer has the possibility, before any legal action, to seek an amicable solution in particular with the help of a professional association of the sector, a consumer association or any other advice of his choice.
